Public-record analysis · Sources reviewed October 27, 2026. Corporate proceedings and company statements are distinguished from allegations about individuals.

Start with the question

Use the Fifth Circuit opinion for the scope of the 2024 legal ruling. Use EPA’s laboratory material for what was tested and observed. Use the company’s own publication for its response. No one document answers all three questions, and citing a court opinion does not automatically support an unrelated claim about chemistry.

Separate the later proceedings

The disclosure complaint concerns claimed confidentiality. The March 2026 memorandum concerns the administrative record in that litigation. The May 2026 appellate opinion concerns standing in a different action. Treating these as one continuous judgment obscures both the company’s arguments and the environmental groups’ procedural position.
