Discovery and response

EPA’s account begins with a contamination report concerning a mosquito-control pesticide in 2020. Subsequent work connected the issue to certain fluorinated containers. The agency issued an industry letter in 2022 and later orders directed at PFAS generated during Inhance’s process. These were regulatory developments, not a criminal conviction.

The 2024 turning point

On March 21, 2024, the Fifth Circuit vacated EPA’s challenged orders. In July that year, EPA announced that it had granted a petition seeking action through a different TSCA route. The distinction matters: a successful challenge to one statutory mechanism does not erase the underlying test results or automatically create a replacement prohibition.

Disclosure becomes a separate issue

Inhance filed a reverse-FOIA complaint in April 2025 concerning claimed confidential business information. A March 2026 opinion addressed completion of the administrative record in consolidated disclosure litigation. Keep that dispute separate from the May 2026 appeal involving environmental groups’ standing. A chronological account should identify the case number as carefully as the date.
